Agreement
These Terms of Service are a contract between you and Nexlume Media LLC, a New Mexico limited liability company (Business ID 0008127980), for the no-referer.com website and the short-link service on it. Each time you use the site, you agree to these terms and to the Privacy Policy.
If you do not agree, stop using the site. Notices under these terms may be given on the website or by email to the address on your account. You agree to receive those notices electronically.
The operator is Nexlume Media LLC. Registered office: 1209 Mountain Road Pl NE, Ste R, Albuquerque, NM 87110, United States. References to “we” and “us” mean that company.
The service
The service lets you create a short /r/{code} address, optionally with an alias, that redirects to an https destination. Signed-in use adds My URLs and a click count for links on the account.
Some use is free. Pro, Bulk, and Enterprise are paid or custom arrangements. Features can change, and a plan can limit volume. The service is offered as available. We may refuse a destination that fails the https rules or that we believe breaks these terms.
Accounts
You may shorten a link without an account. An account is required for history under My URLs.
Eligibility
You must be at least 18 years old, or the age of majority where you live, and able to form a contract. If you use the service for an organization, you confirm that you can bind that organization.
Your login
Registration details must be accurate and kept up to date. You are responsible for activity under the account, including links created by anyone you allow to use it. Tell [email protected] if you believe the login was used without permission.
Acceptable use
You agree that you will not use the service to:
- Distribute malware, phishing, scams, spam, or other unlawful content.
- Infringe copyright or other rights, or mislead people about where a short link goes.
- Publish sexual content involving minors, or content that threatens or harasses a person.
- Probe, disrupt, or overload the service, or bypass a security control.
- Create links whose only purpose is to track or relay spam.
Destinations you choose
You choose the destination URL. We do not review every page before a code is issued, beyond the https and safety checks described on the site. You are responsible for the page that opens and for having the rights to share it.
If the information you give us is false, or if we reasonably believe a link or account breaks these terms or the law, we may suspend the link or the account and refuse further use.
Plans and fees
Free use does not require a card. A paid plan is agreed with us, including by email to [email protected]. Fees are in the currency stated in that agreement. This website does not store full payment-card numbers.
If a trial or introductory period is offered, we will say when the paid price starts. You can stop a paid plan as the agreement describes. Charges already due remain payable.
Intellectual property
The no-referer name, the site design, and the software belong to Nexlume Media LLC or its licensors. You receive a limited right to use the service as offered. You may not copy the platform, reverse engineer it, or resell it as your own shortener.
You keep your rights in the destination pages you link to. You give us the limited permission we need to store the URL and redirect visitors to it.
Third-party sites
A short link can open a site we do not control. We are not responsible for that site’s content, policies, or practices. Your dealings with the destination are between you and that site.
Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
We do not warrant that redirects will be uninterrupted, error-free, or free from harmful destinations chosen by users.
Limitation of liability
To the maximum extent permitted by law, Nexlume Media LLC and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the service.
Our aggregate liability for claims relating to the service will not exceed the greater of (a) the amounts you paid us for the service in the twelve months before the claim or (b) USD 50, except where liability cannot be limited under applicable law.
Indemnification
You agree to indemnify and hold harmless Nexlume Media LLC and its personnel from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the service, your destinations, or your violation of these terms or applicable law.
Suspension and termination
We may suspend access, disable a short link, or close an account if we reasonably believe these terms were broken, if the link creates a risk of harm, or if the law requires it. We may do that without advance notice when the risk is immediate.
You may stop using the service at any time. Sections that should survive by their nature, including liability limits, indemnification, and governing law, continue to apply.
Disputes and governing law
These terms are governed by the laws of the State of New Mexico, United States, without using conflict-of-law rules that would pick another jurisdiction’s law solely to avoid that result.
Except where a mandatory consumer rule in your country says a local court must hear the claim and that rule cannot be waived, venue for disputes that may be brought in court lies in the state courts of Bernalillo County, New Mexico.
Before filing, write to [email protected] with a short description of the dispute and give us 30 days to respond. That step does not limit a right that the law says cannot be delayed.
Changes
We may update these terms by posting the new version on this page and changing the Last updated date. A material change may also be noted on the site. If you keep using the service after the new effective date, you accept the updated terms where the law allows that.
If you do not accept a change, stop using the service.
